β€œIt is possible that the court will rule in a way that preserves at least some, if not all, of state tort claims related to climate harms,” said CPR Member Scholar Rachel Rothschild of Michigan Law School. @umichlaw.bsky.social

After listening to oral arguments in Suncor v. Boulder just now, I hope someone will give Justice Kavanaugh my @yalelawjournal.bsky.social Essay on the case. It provides a detailed history of Ouellette & the other precedents invoked in Suncor. These cases do not say what Justice Kavanaugh asserted.

UCLA law professor Alejandro Camacho described the β€œpreemption arguments as the latest and perhaps most ambitious effort to weaponize federal law to prevent polluters and fraudsters from paying for the harms they cause.” πŸ‘‡

The Supreme Court just heard a major climate case yesterday! βš–οΈ

The arguments offered some clues about where the justices may be headed. But there was one powerful answer to a key argument that never made it into the courtroom.

Recently, Rob Glicksman (GW Law) and I submitted a public comment in opposition to USDA's proposed recission of the Roadless Rule. This move by USDA/Forest Service is as unnecessary as it is shortsighted.
