In Part Three of the Ohio Repro Says #FlockNo series, we examine recent Federal & State-led efforts to criminalize pregnancy, miscarriage, & abortion care — and the very dangerous situation that can create for Black birthing people right here in Ohio.

But without the limited protections offered under Roe, and as anti-abortion extremists continue to stoke vitriolic disinformation, pregnant people — especially Black and Brown pregnant people — are facing increased surveillance and even criminal charges for seeking abortion care, managing miscarriage treatment, and navigating life-threatening complications.

According to Pregnancy Justice, during the 2025-2026 legislative session more than 10 "fetal personhood" bills were introduced. At least 12 states introduced bills that would charge a person who received an abortion with homicide — with the death penalty being a possible sentence."Graphic with purple background and a half-tone effect in the corners.

After multiple hospital visits where Watts was repeatedly denied abortion care — standard treatment for any pregnant person who has miscarried or whose pregnancy is otherwise nonviable — in part, due to Watts’ proximity to Ohio’s abortion restriction at 22 weeks, Watts returned home where she would unfortunately miscarry soon after.

Brittany Watts was forced to miscarry alone in her bathroom.

Instead of being met with compassion and grace from hospital staff, Watts was arrested under false suspicions, and charged with with a crime before she could even process what she’d experienced. Though the charges were later dropped, the precedent this case set for pregnant Black women in Ohio is terrifying."
