Guantanamo Dispatch: All Four Defendants’ Confessions Are Now Suppressed in the 9/11 Case at www.justsecurity.org/160118/guant...
The mission has cost more than $100 million, the study said. A recent visit found nearly 450 government employees and zero detainees. “This comes at a significant cost to taxpayers and undermines military readiness,” the report said.
Good morning. Here's the big news that broke over night. Prosecutors are 5-0 in their losses to the so-called "clean team interrogation" challenges. The government is still deciding whether to appeal this one.

Breaking news: The military judge just threw out the confessions of the fourth defendant in the 9/11 case -- which has gone on so long in part because prosecutors fought hard to keep them. It's a blow to the Bush administration's clean team theory. Scorecard: 5-0.

Explained here in detail for the deep divers who follow @justsecurity.org…
A military judge has thrown out the confessions of Mustafa al-Hawsawi, a capital defendant in the 9/11 case at Guantanamo Bay. Carol Rosenberg reports:
Three years ago, we ran this analysis on how a military judge’s adverse “clean team” ruling shook a foundation of the US government’s cases at the post-9/11 court at Guantánamo. Now that two more judges have followed him, here’s a look back at that explainer. www.nytimes.com/2023/08/26/u...
Subpoena power? Not exactly. Acquittal means freedom? Nope. A few unusual things that came up last month in the longest running capital case at Guantánamo Bay.

So the admissions to federal agents by three of the four defendants are out, and a ruling is stlil pending on Walid bin Attash. No word yet from the chief prosecutor on whether his office will appeal today's decision to try to reinstate the so-called clean team confessions.
FBI agents didn't tell the prisoner his statements could be used against him when they questioned him at a former CIA black site in Guantanamo in 2007, his fourth year in U.S. custody. Mustafa al-Hawsawi is accused of helping the 9/11 hijackers with finances and travel arrangements.
Breaking news: A military judge has thrown out yet another confession in the 9/11 case, ruled it was involuntary.
The judge also gave defense lawyers until 10/9 to submit filings on still disputed "proposed substitutions in lieu of testimony for approved defense witnesses." Translation: They are haggling over government documents in place of human testimony that might be favorable to the defendant.
Update: In an order, the judge says the lead defense lawyer in the USS Cole case has left Guantanamo "to seek medical care CONUS,*" and points to a series of filings on the lawyer's health care crisis of a year ago. *Continental United States
News: The judge in the USS Cole bombing case has canceled the rest of this week's pretrial hearings because of a lawyer's health emergency that can't be handled at Guantanamo Bay. www.justsecurity.org/159334/guant...
Good afternoon from Camp Justice: The court is closed today for Nashiri defense lawyers to examine would-be trial evidence. We saw a bunch of exhibits back in 2017 in Judge Spath's preadmission hearings, which were subsequently overturned.
Latest: The court is in recess until Wednesday when we expect another closed, national security hearing. No public, no defendant.
Pretrial hearings are in closed session today as the court works on national security documents (in lieu of live witnesses) the prosecution wants to present the jury.
Good morning from Camp Justice at Guantanamo Bay, site of the offshore war court where a defendant may not go free even if his death-penalty jury were to declare him not-guilty. My latest dispatch here. @justsecurity.org

I am also hearing that the Army’s “Sanity Board” psychiatrist is arriving this weekend. More reports coming...
