Since our case was covered in the Guardian on Sunday, people have reached out to ask if they can do anything to help. We think MPs should know that the Home Office is blocking these families from reuniting, defending unlawful decisions - actions that are at odds with the govt’s recent messaging.

Home Office unlawfully blocking Palestinian families from reuniting

Our case won in court - but the Home Office says it will appeal, meaning families trapped in Gaza in grave danger for many more months.
 
 Find out what you can doYoung mothers and small children are stranded in Gaza, going to bed each night to the sound of bombs, with rats and mice in their tent. They are malnourished and sick from dirty water.

The fathers are in the UK, have been granted protection status, and are sick with worry and fear for their families’ lives.

Their only option is to be allowed to leave Gaza before undergoing security checks. The Home Office can make this happen.

The court found that in refusing to allow them to do so, the Home Office is applying its own policy unlawfully.You can use our template letter to write to your MP to say that: 

 The Home Office’s decisions don’t align with the government’s recent messaging and commitment to support Palestinian people from Gaza.
We are only asking the Home Office to apply its own policy lawfully, allowing the families who meet the family visa rules to leave Gaza and reunite in the UK.
Every day the families have to wait, they suffer harm and their lives are at risk.

Also quite misleading to say children will be exempt from the refugee tax. Yes a 5 year old won't be expected to pay but their parents will and that will still keep that child at destitution levels, taking vital earnings and benefits income from families.

The Home Office has a policy for reuniting families even when biometrics cannot be obtained. It is choosing NOT to apply this, leaving women and children trapped in Gaza. Great work from GMIAU, challenging this unlawful practice 👏

But the most vulnerable families, facing death in Gaza every day, are left behind. The Home Office is spending significant public money defending unlawful decisions and keeping these families apart. People have died waiting for the outcome of these challenges - they do not have time to wait.

Recently, the Prime Minister said “the suffering of the Palestinian people is a scar on the conscience of the world". This week the Home Secretary announced the re-opening of the resettlement scheme, allowing small numbers of Palestinian refugees based in Jordan and Lebanon to come to the UK.

The Upper Tribunal determined that the Home Office’s decision to refuse them under the Unsafe Journey Policy is unlawful and not compliant with their right to a family life, and has ordered the Home Office to take new lawful decisions. But the Home Office says it plans to appeal.

The families meet all the Immigration Rules for the family visa route, and if the Home Office applied its own policy lawfully, the families would still undergo robust security checks before entering the UK. Our Solicitor Decla described the suffering they are enduring while waiting:

Decla Palmer, a solicitor at Greater Manchester Immigration Aid Unit who represents the families, said: “The Home Office is doing everything possible to delay and to defend its unlawful decisions, taking a policy position that blocks people in Gaza who are eligible to come to the UK from being able to do so.

“These families are completely broken – it is difficult to put into words the trauma they have faced and continue to endure. The mothers and children, trapped in Gaza, are suffering each and every day. The fathers, in the UK, are facing the prospect that they may never hold their children again. The Home Office is actively keeping these families apart, leaving them stranded in Gaza in grave danger.”

‼️ A win in court ‼️ But the Home Office is still keeping families apart. The judge made a significant decision in our case this week - ruling that the Home Office should allow the mothers and children we represent to leave Gaza to reunite with their loved ones.

Every death in our Channel could be prevented. The three people who died trying to reach safety yesterday were betrayed by politicians, who've chosen to ignore the evidence and prioritise deadly hostility over saving lives. But this tragedy doesn't have to be repeated. Safe routes save lives.

To be clear, resettlement schemes, as proposed here (where the screenshots are from), are good. But not everyone can wait around in dangerous situations, hoping to be plucked to safety by the UK government. Using resettlement as a reason to crack down on spontaneous asylum claims is therefore bad
