Don’t let the simple ballot language fool you. These amendments make significant changes to our Constitution, and the ballot doesn’t tell the whole story. **These are Nashville Indivisible Steering Committee recommendations. We encourage voters to do their own research**

The graphic explains AMENDMENT 3 — Expanding Victim' Rights / Marsy's Law

What It Is:
A constitutional amendment commonly known as Marsy's Law that would replace Tennessee's existing constitutional victims' rights provision with a broader 13-part version.

What It Does: Replaces Tennessee's existing constitutional Victims' Bill of Rights with an expanded version known as Marsy's Law.

What It Doesn't Do:
It doesn't create victims' rights in Tennessee. Tennessee has enshrined victim’s rights. Important: Tennessee victims already have constitutional rights. Voting NO does not take those rights away.

Why We Say NO:
Many of the goals are worthwhile. But the amendment creates expanded constitutional requirements while leaving significant questions about implementation, staffing, workload, due process for the accused and unresolved cost estimates.

Those protections can be strengthened, funded and implemented through state law without permanently placing unresolved procedural requirements into the Constitution.

The amendment also creates new constitutional enforcement and notification requirements without clearly resolving how they will work or how it will be implemented.

We support victims. We don't believe these unresolved provisions belong permanently in the Tennessee Constitution.

The goal is good. The constitutional mechanism is questionable.

AMENDMENT 2 — PERMANENTLY BANNING A STATE PROPERTY TAX
WHAT IT IS:
A constitutional amendment that would permanently prohibit Tennessee from imposing a state property tax.
WHAT IT DOES:
Tennessee hasn't had a state property tax for roughly 80 years. Amendment 2 would prohibit future state property taxes on residential, agricultural, commercial, industrial and public-utility property, as well as other taxable property.
WHAT IT DOESN'T DO:
It does not eliminate existing county or city property taxes.
Voting NO does NOT create a state property tax. It simply leaves the Constitution and current law unchanged.
WHY WE SAY NO:
Tennessee already operates without a state property tax. Amendment 2 would permanently remove a revenue option from future lawmakers, including the ability to tax commercial and industrial property at the state level.
This isn't just about protecting homeowners. It's about changing our Constitution to prohibit a tax Tennessee doesn't currently impose.

Graphic explains the following - AMENDMENT 1 — EXPANDING NO-BAIL DETENTION
WHAT IT IS:
A constitutional amendment expanding when a judge may deny bail to someone awaiting trial.
WHAT IT DOES:
Tennessee's Constitution currently allows bail to be denied for capital offenses. Amendment 1 would expand that exception to include specifically named serious crimes plus 73 additional felony offenses tied to Tennessee's 85%-sentence requirement.  Those 73 offenses are not all listed on the ballot.
WHAT IT DOESN'T DO:
It does not make these additional crimes capital offenses. Instead, it expands the constitutional exception to the right to bail—currently reserved for capital offenses.
WHY WE SAY NO:
Being accused is not the same as being convicted. The Constitution already permits denial of bail for capital offenses. Amendment 1 would greatly expand the government's power to hold people without bail before trial—and voters aren't even given the complete list of affected crimes on the ballot.
- Being charged is not being convicted.
- People are presumed innocent until proven guilty.
- The ballot doesn't even list all of the crimes covered.
- The Constitution already allows bail to be denied for capital offenses.
