No, I was faulting the Dems for passing AEDPA to begin with, and for their role in the architecture of this system that continues to torture and kill people. I certainly wish the Dems would repeal it/FDPA but I wasn't speaking to what's possible politically or how we end the DP. Thanks.

Respectfully I wasn’t trying to “both sides.” By fed context I largely meant politically, in terms of Dem admins, not in terms of the impact of say AEDPA, which I know has hurt state prisoners (& have written as such.) Think we agree more than we disagree. Congrats to your client on the fed row.

I think you need to remember that the death penalty is not just executions but death penalty authorizations, prosecutions, clemency decisions, etc. in all those areas the Dems have enabled and upheld this system. Executions don’t happen without all of that. Again, I invite you to read more.

AEDPA has played a huge role in ensuring executions are carried out without further legal review and I am sorry to say that is a major part of the Democrats’ legacy in ways we pay for constantly.

I’m not telling you not to vote for Dems if you care about this issue, I am saying that Dems have been largely historically terrible on it and, yes, central to perpetuating the violence in question.

In the fed context, which is largely what I was discussing, there’s no question the Dems have been central, not just the crime bill but AEDPA, Obama’s refusal to grant clemency prior to Trump, and more recently backing away from abolition in their party platform. Not enough and also enabling yes
