STATEMENT OF ABBE LOWELL AND NORM EISEN, COUNSEL FOR FED GOVERNOR LISA COOK, IN RESPONSE TO WHITE HOUSE "HEARING" ANNOUNCEMENT

44
@klasfeldreports.comOct 9, 2026, 4:12 PM

The Kennedy Center's Trump-installed Board MUST produce financial information for its 2026 fiscal year, a federal judge rules.

Judge Cooper "highly doubts that the Center has operated without core financial reporting over the past year."

Doc buff.ly/3CFYynC

As for burden, the Court highly
doubts that the Center has operated without core financial reporting over the past year. Surely the Center has ready access to periodic income statements, balance sheets, cash flow reports, and budget documents that reflect actual financial performance over FY 2026, not just projections.
The Center should be able to gather these materials from existing sources without having to query its “updated” financial system for bespoke reports. If that is not the case, standardized
reports will do. So, although Plaintiff’s exhaustive requests are unduly broad given the expedited timetable, the Court hereby orders Defendants to produce FY 2026 financial statements of the nature noted above sufficient to show the Center’s financial performance and condition over FY 2026.

We'll see if the judge ultimately allows any. The Board claims some are necessary for security and safety concerns. Judge Cooper will rule on their proposals.

The disqualified, loyalist US Attorneys pursued Trump's political agenda. * Halligan charged Tish James and James Comey. * Sarcone investigated James. * Habba targeted Dems performing immigration oversight. * Essayli claimed election fraud on TV. Rogoff did none of that — so Trump wants him out.

Let's not lose sight about the big picture here. Courts keep telling Trump that he's defying the constitution—trying to end-run Congress and the judiciary—to keep his top prosecutors in half a dozen states. All to have loyalists decide who to criminally charge with what in a DOJ under his thumb.

KAdam Klasfeld@klasfeldreports.comOct 1, 2026, 11:37 PM

Here's the crux of the ruling blocking Trump from firing court-appointed US Attorney Roger Rogoff in Seattle: Allowing it would "upend" the constitutional order. Trump's tried to end-run Senate confirmation for US Attorneys in five states and failed. Now, he's gunning for the judiciary's power.

Allowing the President to fire a court-appointed U.S. Attorney would upend
the framework created by the Constitution and the statutory framework, which together balances the President’s right to appoint and the Senate’s right to confirm. Allowing the President to fire a court-appointed U.S. Attorney also eliminates the incentive to nominate a candidate that can be conferred by the Senate—in other words, bypassing the requirement that the Executive and Legislative branches work together to nominate and confirm the U.S. Attorney.

Lucky break for Hearn's prosecutors?

After dismissing the case with prejudice, Judge Edelman, in the last footnote, declines to rule one way or another on whether feds acted in bad faith.

Prosecutors have an excuse not to pursue a lousy case and avoid a damning finding. buff.ly/wu0xyjN

Scathing from Judge Edelman: Given his first indictment, the notion that the grand jury process would protect David Hearn from another "meritless, politically driven prosecution" is nothing short of "facetious."

Given the process that led to the Indictment in this case, Mr. Hearn and the public
cannot view the promise that a future grand jury would protect him against a meritless,
politically driven prosecution at some point in the future as anything short of facetious ‘The government indicted Mr. Hearn at a near-record pace, with the grand jury voting on the charge less than two weeks after his arrest. At the time the Indictment was returned, some of the government's own initial conclusions as to the origins of the damage to the Reflecting Pool’s liner were equivocal at bes
