And on that note, using “that’s just the law” to mask prejudiced attitudes is not something I’m keen to let anyone get away with. The law often lags on what is correct. Fundamentally we’re talking about segregation. Which side are you on?

How sex is defined is the issue. Denying trans women participation in women’s sports is ultimately an equal protection issue—regardless of where courts currently fall. And yeah, we’re going to have to codify protection for trans folks the same we did with civil rights.

The right to equal protection under the law is fundamental. Trans women are women. Trans girls are girls. Trans men are men. Trans boys are boys.

It’s not tho. It’s discrimination—and they’re trying to codify it. Curtailing the rights of any group by law is a serious five alarm fire. Especially—not incidentally—when it’s a small minority of the population.

This is a fascist nightmare. Politicized law enforcement and deliberate targeting of an elected official who has been critical of the regime. Everyone involved needs to be identified and prosecuted. Trump needs to be impeached and removed from office and put on trial for his various crimes.

A good summation of David Brooks and "civility" politics generally: no one on the right-wing can ever be described honestly, while everyone who isn't on the right-wing is always portrayed as a radical breaking cherished norms.

Don’t throw trans people under the bus. It’s not hard. It’s also such a clear litmus test.
