In response to Judge Ana Reyes, the Trump DOJ argues that plans to redesign East Potomac Golf Course do not constitute final agency action subject to judicial review, comparing the project to redesigning museum exhibits or mowing the lawn. DOJ also states that its attorneys were not representing Trump’s actual position or thoughts, but interpreting his public statements, and asserts that any direct communications with Trump would be protected by constitutional privileges. The filing is signed by Associate Attorney General Stanley Woodward Jr.
