Interesting take on perhaps one of the less predicted implications of US sanctions against the ICC

Any public statement by a state saying something similar to 'international justice and the rule of law needs to be protected at all cost' should be read alongside the inevitable individual calculations states are making about their own agendas and priorities.
with a shared consensus of what dialogue actually means, what are the parameters of that dialogue, how in practical terms dialogue would bring about the desired outcome of sanctions withdrawal (without sacrificing the legitimacy of the court) etc...
International criminal justice, from its origins at Nuremberg, was built on the foundations of politics, power & selectivity & therefore we should not really be that surprised that these things are now directly shaping the ways states are responding to US attacks against the ICC.
for relief from sanctions would be deeply misguided and could seriously undermine both the Rome Statute and the foundational principles on which the Court is built. - www.amnesty.eu/news/eu-must...
by suggestions that the appropriate response
to the USA’s sanctions ultimatum is ‘dialogue’ with the United States or consideration of Court ‘reforms’ to accommodate its demands ... Any willingness to even consider, let alone seriously entertain such concessions in exchange

Amnesty International understands the fallacy of a 'dialogue approach' to US sanctions against the International Criminal Court. This is obvious to them & so many others & yet here we still are with many states wanting to 'talk'.....
Amnesty International is also deeply concerned

It is as if they think if they say it often enough, loud enough, and with enough conviction it will somehow suddenly become true.

In case the sound is a bit muffled at the back of the room, talking, dialogue, strong words etc... during the next 6 months are not going to make the Trump administration actually withdraw the sanctions from the ICC.

I wrote some short explainers and comments on last Friday's announced US sanctions against the International Criminal Court
In short, state's calculations to ensure that the ICC does not actually close, is as much a political and diplomatic calculation, as it is about upholding international law and human rights.
Whilst the way states do/or don't respond to the current sanctions could likely advance the courts move to less and less relevance, however I think it is very difficult to imagine a scenario where states explicitly have allowed the court to close.
much for us, we give in, and give up on international criminal justice, which in effect is what they would be saying if they allow the court to close.
The announced US sanctions against the ICC are undoubtedly a massive threat to the court. That said, it would be a huge political decision, and arguably a big political risk, for enough states to actually 'stand up' and say that these sanctions and US pressure are too
State's calculations to ensure that the ICC does not actually close, is as much a political and diplomatic calculation, as it is about upholding international law and human rights.
These decisions, one by one, are an important part of the constellation of action needed to help the ICC navigate the continuing US aggression against the court.
There are also ongoing cases including Fortify Rights founder Matthew Smith and rights lawyer Akila Radhakrishnan in which the court recently rejected the Trump's administrations attempt to dismiss the case.
