I've had the same thought about seats on SCOTUS. If (eg) Trump could nominate and the Senate confirm two justices now IN CASE 1-2 vacancies were to occur before noon on Jan 20, 2029.

In any event, I'm _thinking_ Trump wouldn't have the votes.

… a H/S decision to count/not count ballots after a state did the opposite would ~depend on which party already held the majority and whether it would help them. Iow, that process ~wouldn't change which party held the majority, but it could change the size of the majority's margin.
