Rahimi said the proper venue for prosecuting the Minab school massacre would be the International Criminal Court (ICC). Neither Iran nor the U.S. have formally recognized the court’s jurisdiction. “Since we are not actually members of the ICC, we cannot file this complaint ourselves,” he said, adding that Iran was encouraging other states and non-governmental organizations to submit requests to the court. “Perhaps we can say that the most important authority that can confront these aggressors—which is necessary—is the ICC.” Brody said the rules of the ICC would technically allow Iran to accept its jurisdiction by lodging a declaration with the ICC’s registrar, but it could not do so only in the interest of seeking an indictment against U.S. officials responsible for the Minab strikes. It would require that Iran accept the court’s jurisdiction over Iranian officials as well, a move Tehran is unlikely to pursue, particularly given the U.S. hostility toward the ICC. Since his first term as president, Trump has waged war against the international court, sanctioning its personnel and openly defying the arrest warrants against Israeli Prime Minister Benjamin Netanyahu and former defense minister Yoav Gallant, who frequently visit the U.S. and, in Netanyahu’s case, the White House.
